Severance pay (Kıdem Tazminatı) is a statutory compensation paid to employees in Turkey upon termination of their employment under specific qualifying conditions. The employee must have worked for at least one full year. The calculation is based on 30 days of the last gross salary per year of service, subject to a statutory ceiling.
In Turkish Labor Law, severance pay serves as a reward for the employee's loyalty and wear-and-tear during their tenure. While the current Labor Law No. 4857 is in effect, the rules governing severance pay are still dictated by Article 14 of the former Labor Law No. 1475, which remains exclusively in force for this purpose.
To qualify for severance pay, three main conditions must be met cumulatively:
Not every termination results in severance pay. The law clearly outlines the specific scenarios where the right to severance pay arises, depending on whether the termination is initiated by the employer or the employee.

While a standard voluntary resignation disqualifies an employee from severance pay, the law grants exceptions in the following specific cases:
Severance pay is calculated by granting 30 days' wage for each full year of service. Periods shorter than a year are calculated on a pro-rata basis.
There is a maximum limit (ceiling) to the amount of severance pay an employee can receive per year of service, regardless of how high their actual salary is. This ceiling is tied to the maximum retirement bonus of the highest-ranking civil servant and is updated semiannually (January and July) by the Ministry of Treasury and Finance.
If the employer fails to pay the severance pay at the time of termination, a judge will rule for the payment of the highest deposit interest rate (en yüksek mevduat faizi) applied by banks for the period of delay. Furthermore, claims for severance pay are subject to a 5-year statute of limitations (zamanaşımı) starting from the date of termination.
Employees must have at least one full year of service and the employment contract must be terminated for specific qualifying reasons, such as unfair dismissal, retirement, compulsory military service, or a female employee's marriage.
It is calculated as 30 days of the employee's last gross wage (including regular bonuses, food, and transport allowances) for each full year of service, up to a government-determined maximum ceiling.
Generally, an employee who resigns voluntarily without a "just cause" (haklı neden) is not entitled to severance pay. Exceptions include resigning for retirement, military service, or female employees resigning within one year of marriage.
